Port Authorities Act 1999
The Port Authorities Act 1999 governs Western Australia's port authorities, covering their functions, responsibilities, concept of operations and related matters.
Under the Act, the port authorities may operate as Government Trading Enterprises, with appropriate accountability to the State Government.
Shipping and Pilotage Act 1967
The Shipping and Pilotage Act 1967 (WA) governs shipping and pilotage in and about ports, boat harbours and mooring control areas of the State.
Ports governed under the Shipping and Pilotage Act 1967 are overseen by the Department of Transport (DoT).
As part of the State Government’s Ports Governance Reform Program, work is underway to eventually move all trading ports in WA under the Port Authorities Act 1999, which means port management will be transferred from DoT to the relevant port authority.
Government Trading Enterprises Act 2023
WA port authorities operate as government trading entities.
The Government Trading Enterprises Act 2023 was introduced to consolidate the governance requirements of Government Trading Enterprises (GTE), while maintaining appropriate flexibility for practices to adapt to industry, market and Government policy changes over time.
The Act provides GTEs with clarity on their relationship with Government, and consolidates the governance, strategic planning, and financial management provisions.
