Exemptions

Find out about current exemptions from marine safety legislation requirements.

The Department of Transport (DoT) has the power to grant exemptions from the current marine safety legislation requirements for boating and other on-water activities. 

You can seek an exemption if it is unreasonable, impracticable or possibly even unsafe to comply with the rules.

For example, Surf Lifesaving WA rescue craft may need to exceed the speed limit and, in some cases, not carry certain safety equipment because it is safer while operating in surf and other high risk conditions or situations.

DoT can issue an exemption providing the need is justified and other measures are put in place to mitigate any risks.

Exemptions can be issued for set periods normally associated with approved aquatic events or on water works and construction or on an ongoing basis.
