Reviewing the Transport (Road Passenger Services) Act 2018
About the review
The Department of Transport and Major Infrastructure (DTMI) must review how well the Transport (Road Passenger Services) Act 2018 (the Act) is working, as soon as possible after it has been in place for 5 years. The Act was introduced in stages, with full implementation reached in 2021, including the transition to passenger transport driver authorisations.
This review will help us understand how the Act is operating in practice across the WA passenger transport industry, with key focus areas including:
- Safety of services
- Accessibility
- Ease of entering and leaving the industry
- Innovation
- Equity and industry support (including Wheelchair Accessible Vehicle grants)
- Enforcement and compliance.
DTMI has engaged Painted Dog Research, an independent research agency in Perth, to carry out preliminary research about how the Act is working for industry.
Members of the WA passenger transport industry were invited to complete a short online survey about their experiences operating under the Act.
All feedback from the preliminary consultation will be analysed and used to inform the scope of the full Act review. DTMI will continue updating industry as work progresses on the Act review – make sure to watch your email inbox for the latest WA passenger transport industry news.

Passenger transport vehicles
Number of authorised passenger transport vehicles
Passenger transport vehicles (PTVs) can be authorised in multiple categories, including:
- on-demand rank or hail (OD-RH) (taxi);
- on-demand charter (OD-C);
- tourism passenger transport (TPT); and
- regular passenger transport (RPT).
Wheelchair accessible vehicles (WAVs) are vehicles that meet specific safety and accessibility standards, including the installation of a ramp or hoist, and appropriate wheelchair restraints. Only WAVs with an on-demand rank or hail category of PTV authorisation can access the Passenger Transport Subsidy Scheme (PTSS) in WA.
Note: When reading the below data, be aware that the total number of authorised PTVs is not equal to the sum of all categories as PTVs can be authorised in multiple categories.

Notifiable occurrences and alleged driver conduct reports
A notifiable occurrence is an incident of a serious nature that involves, or has the potential to result in injury, violence or abuse of a person. ODBSs are required to submit details of notifiable occurrences to DTMI as soon as is practicable.
An alleged driver conduct report is a report made by an authorised ODBS to notify DTMI of allegations that a driver of an on-demand PTV was engaged in conduct that would affect the driver’s suitability to drive in the on-demand transport industry.
Alleged driver conduct reports must be made within 48 hours of the ODBS becoming aware of the alleged conduct.
